On what grounds are they suing? Do they claim that only retailers authorized by them can sell their products? Unless I'm mistaken, that has always run afoul of the First Sale Doctrine, so that if you bought from an authorized source, you had the right to re-sell it on any venue, whether eBay or a yard sale.

That said, First Sale Doctrine would allow a Distributor to sell to someone, who could then sell online. My guess is that Melaleuca is asking Ebay for Member names t o ensure that their Distributors aren't in violation of their contracts I have to admit, I had never heard of Melaleuca until this thread.
